TERMS AND CONDITIONS – DATAGROOVE

1. General Information

The owner of the Datagroove online store (hereinafter – the Store) is
OÜ Datagroove, registration number 17054265,
registered address: Tungla tn 8, Tallinn, Harju County, 10911, Estonia.

These terms and conditions apply to all purchases made in the Store.

2. Product Prices and Payments

All prices are displayed next to the respective product and include value added tax (VAT).
Delivery costs are added to the price and are shown during the checkout process.

Orders can be paid using online banking or other payment solutions offered by the Store.
The purchase agreement enters into force once the payment has been received in the Store’s bank account.


3. Product Information

All information about products (description, technical specifications, availability) is provided directly next to the relevant product.
Only products that are actually available in stock and ready for dispatch are displayed in the Store.


4. Placing an Order

  1. Select a product and add it to the shopping cart.

  2. Complete the required data fields and select a delivery method.

  3. The total order amount will be displayed on the screen.

  4. Pay for the order using the selected payment method.

If the ordered product cannot be delivered due to being out of stock or for any other reason, the customer will be informed as soon as possible.
Any amounts paid (including delivery costs) will be refunded no later than within 14 days.


5. Delivery

Products are delivered within Latvia.

Delivery costs and available delivery options are displayed during the checkout process.

Estimated delivery times:

  • Within Latvia: 1–7 business days

  • International shipments: in accordance with the terms of the selected delivery service provider

In exceptional cases, the delivery period may extend up to 45 calendar days.


6. Right of Withdrawal (14 Days)

The customer has the right to withdraw from the contract concluded in the online store within 14 days without providing any reason.

The right of withdrawal does not apply to:

  • products made according to the customer’s individual order

  • products that deteriorate rapidly or have a short expiry date

  • opened hygiene and personal care products

  • products that have been irreversibly mixed with other items after delivery

  • digital content delivered electronically with the customer’s explicit consent

(PTAC requirement: exclusions are clearly listed.)

Conditions for exercising the right of withdrawal:

  • The product may only be inspected to the extent necessary to determine its nature, characteristics and functioning (as in a physical store).

  • If the product has been used more than necessary or shows signs of wear, the Store may reduce the refundable amount.

  • The withdrawal form must be sent to shop@datagroove.lv no later than 14 days after receipt of the product.

  • The cost of returning the product is borne by the customer, except where the product does not correspond to the order.

The customer must return the product within 14 days after submitting the withdrawal form.
The Store will refund all payments received no later than 14 days after receiving the returned product or proof of dispatch.
If the customer selected a more expensive delivery method than the standard option, the additional cost will not be refunded.


7. Non-Conformity and Warranty

The Store is liable for any lack of conformity of the product with the contract that becomes apparent within 2 years from the delivery of the product.

Important distinction (PTAC requirement):
Within the first 12 months after delivery, it is presumed that the defect existed at the time of delivery.
The burden of proof to the contrary lies with the Store.

The customer must notify the Store of any defect within 2 months of discovering it:

The Store will:

  • repair the product, or

  • replace the product with a new one, or

  • if this is not possible, refund all amounts paid.

The Store will respond to the customer’s complaint within 15 days.


8. Processing of Personal Data and Direct Marketing

The Store processes the customer’s personal data only for:

  • order processing

  • product delivery

  • customer support

Personal data is disclosed only to delivery service providers.
Marketing messages are sent only with the customer’s explicit consent.
The customer may unsubscribe from marketing communications at any time via the link provided in emails or by contacting the Store.


9. Dispute Resolution

In the event of a dispute, the customer is encouraged to contact the Store:

- the Consumer Rights Protection Centre (PTAC)
- the EU Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr/


Dispute resolution through the commission is free of charge.
